The SEC vs business


I often write about the regulation of business and the relationship between business and government. My position is simple and clear: the less regulation, the better, the ideal - zero impact of the state on business.




My position is the exact opposite of that of the SEC head Gary Gensler. In his view, regulation would increase the efficiency of American markets and thus the economy.

Bloomberg has issued an article stating that giants of Wall Street believe that the SEC’s activities cause real harm to the business, and suffer not only crypto business, but almost all the markets. The Commission is interested in everything from crypto to carbon emission and AI.


The financiers believe that Gensler and the Commission are exceeding their authority.

The activities of the Commission affect too many, depriving them of profit and reducing their effectiveness. 


Crypto business is a very illustrative example of his work. So, the stated goal is to increase business efficiency and protect consumers' rights. What happens in reality? There are very simple questions, the answers to which clearly show the results of the SEC work:


  • Which business has been boosted by delay in issuing Bitcoin ETF?

  • Are there any examples that the SEC rules have brought profit to the crypto business? 

  • Due to the risk of prosecution, crypto companies migrate from the US to countries with favorable cryptocurrency laws. Do American consumers benefit from this?


The problem is not in the specific Commission’s ruling, but in views on the relationship between business and the State.


Every business instinctively aspires to complete freedom.

Gensler is the vanguard of the supporters of full control of almost all business. It is customary to say that he is on the side of the state. No! Under the beautiful term "State" stand elites with their own quiet material interests.


That is why I see in the activities of the commission not the protection of the “State” interest, but an attempt to create unfair competition.
